Had to sue for Breach of Contract
Moving is a two part process. Packing and unpacking. The packing went well. The unpacking was not what I contracted for. After the contract was signed I was advised by the owner that there might be a "shuttling" charge if the semi couldn't get up my driveway even though we had a contract for a flat rate move. When the semi arrived it was a rental. First story, the company tractor had broken down and now they couldn't get up to the house or, as testified in court, we don't send our trucks out of state, it is too costly. Two, contract workers showed up not the four employees promised.One had alcohol on his breath at 9 in the morning. He kept disappearing and returning...not sure what he was doing to get his energy. What I do know is I had to use my own truck to shuttle every item on the semi up to my house. Boxes were being dropped. Furniture that was supposed to be in the house was scattered between the garage and the porch and boxes were stacked sideways and upside down. I carried as much or more than the two contract workers and worked from 9 to 6 to make sure their semi was unloaded. I did not contract to work for them. I did not contract to use my own vehicle. I did not get what I paid for! The magistrate ruled that HTMC breached their contract and awarded damages. Yes, I had to sue in West Virginia. Joseph Pelletier testified that flat rate meant estimate and if anything came up that was more difficult than he had expected during the move it would be extra! Flat rate is not flat rate in his head! He got flustered in court and told the magistrate he had never been in court before...he must have forgotten the multiple convictions for drug trafficking. He is running two different companies out of the same address in Ft Myers with no local business license for the interstate company. He contracts under the name of one company and uses the other to transport. Uses the different companies as shields in complaints. I had to use my pickup truck and my labor to shuttle the furniture to the house. He claimed I should pay him for the use of my truck because of the shuttle. Yes, he really claimed that as a counterclaim in the suit. Contract called for 4 movers...2 showed up hired semi-locally and one was drunk. Also be careful because he went back and altered my contract on line after the delivery. Fortunately I had printed the initial contract and the altered one and put both into evidence. Breach of contract law suit worked for me. This was his last email after having to write me a check to satisfy the judgment I got against him after suing him for Breach of Contract. Don't bother calling ANYONE ELSE !!
I have used this company multiple times - 6 and counting. They arrive on time, their employees are hardworking, careful, aware of your neighbors so as not to inconvenience either old or new. I have never had a damage and despite the fact that moving is stressful, we have a good time.

I asked them when they could do it and they were there prompt and on time they put it in storage when I came to florida I called them and they delivered it.

I didn't hear nothing from them, and ...
The moving was pretty good. I mean, they came to the house, you know, New York. They did the move okay. Everything was fine. The only problem is that they told us everything was going to get moved to Florida. We're in Orlando, but they told us it was going to be in Fort Myers which is like 3 hours away from where we are, and they hold it. They're gonna be here in 7-10 business days. And they gonna call us when they got here. They were supposed to call us, 'cause we still gotta to pay them $300, and we getting 30 day storage for free in Fort Myers. And this has been way over the 30 days since we moved. Nobody ever called us. They were supposed to call us within the first 7-10 days when they picked up the stuff from us to let us know that it was going into storage. And we were supposed to pay another $300 at the end. We already paid $100 and then $375. We have a balance of $300. They got all our stuff. The only thing is I lost everything -- my deed, my phone -- everything, and I don't have their phone number. My wife has their name and everything, but nobody ever called us from that company telling us that they got here with our stuff or anything or for the $300 payment or nothing. Nobody notified us. I mean, the move (when they came to take the stuff) it was good. But after that, nothing... I didn't hear nothing from them, and they got all my stuff.
