Should I sign the bill of lading if some of my items were damaged during the move?

The bill of lading is a legally binding contact which signifies the conclusion of your move. Signing the bill of lading confirms that you have received your shipment, and the service was carried out as agreed upon by you and your mover.

However, if some of your items have been damaged or misplaced, do you still sign the bill of lading? The short answer is yes, but there are some things to keep in mind:

  • Make sure there is no language in your bill of lading releasing your movers from any and liability after you sign the document. You should still be able to file claims for damage after signing. If the document states that the movers are no longer liable for discovered or concealed damage once you sign, you should refuse delivery.
  • Inspect every item on your inventory before signing the bill of lading. If there is any damage, make sure you alert your movers and record it on the bill of lading before signing.
  • You have up to nine months to file a claim for damaged or lost items after your move is complete. Be sure to discuss the claims process with your movers prior to hiring, as well as inquiring about their options for insurance coverage.
